Have a lawyer review before launch.By creating an account or using the tothemixhub platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including engineers (account holders) and client reviewers accessing projects via a share link.
tothemixhub is a platform that allows audio engineers to share audio mixes and masters with clients, collect timestamped waveform-anchored feedback, obtain formal client sign-off, and manage payments — all without requiring clients to create an account.
We provide the platform as-is. We do not participate in the creative work, client relationships, or payments between engineers and their clients except as a technology intermediary.
You must be at least 18 years old to create an account. By signing up, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.
The Service is not available to persons barred from receiving it under the laws of any applicable jurisdiction.
You are responsible for maintaining the security of your account credentials. Do not share your password. Notify us immediately at support@tothemixhub.com if you suspect unauthorised access.
You may not create more than one account per person or organisation without our prior written consent. We reserve the right to disable accounts that we believe are created in violation of these Terms.
You retain all rights to your content.Audio files, project data, comments, and any other content you upload or submit to the Service ("Your Content") remain yours. We make no claim of ownership over it.
By uploading content, you grant tothemixhub a limited, non-exclusive, worldwide, royalty-free licence to store, transmit, display, and reproduce Your Content solely to operate and provide the Service to you. This licence ends when you delete the content or close your account.
You represent and warrant that you have all necessary rights to upload the content — including any underlying compositions, master recordings, or third-party material — and that doing so does not infringe any third party's intellectual property rights.
tothemixhub's brand, software, and platform design are protected by copyright and other intellectual property laws and remain our exclusive property.
You agree not to use the Service to:
We reserve the right to remove any content that violates these rules and to suspend or terminate accounts that engage in prohibited conduct.
Client reviewers are invited to use the Service by engineers. By leaving a comment or submitting a sign-off, you agree to these Terms insofar as they apply to reviewers.
Client reviewers are not direct customers of tothemixhub. Engineers are responsible for having a lawful basis to share audio with reviewers, and for ensuring the reviewer's personal data is processed lawfully under our Privacy Policy.
Comments and sign-off records submitted by reviewers are stored as part of the engineer's project. Engineers control the deletion of their projects and associated data.
Engineer subscriptions: Paid plan subscriptions are billed in advance on a monthly or annual basis through Stripe. Subscriptions auto-renew unless cancelled before the renewal date. You can cancel at any time from Settings → Billing.
Refunds: We do not issue refunds for partial billing periods unless required by applicable law. If you downgrade mid-cycle, your plan remains active until the end of the paid period.
Client payments to engineers:tothemixhub facilitates payments from clients to engineers via Stripe Connect. We act as a technology intermediary only. We are not a party to the underlying agreement between engineer and client. Engineers must comply with Stripe's Connected Account Agreement when using this feature.
Price changes:We will give engineers at least 30 days' notice of any price changes before they take effect.
Your plan includes a storage allowance. Uploading files beyond your plan limit may be blocked or require a storage add-on. We are not responsible for data loss resulting from exceeding storage limits.
On account closure, your data (including all audio files) will be retained for 30 days to allow you to export or migrate, then permanently deleted. Stripe payment records are retained as required by tax law.
We make commercially reasonable efforts to prevent data loss, but we do not guarantee a backup or recovery service. You are responsible for maintaining your own copies of any irreplaceable audio files.
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to our designated DMCA agent:

Your notice must include: (i) identification of the copyrighted work; (ii) identification of the infringing material and its location; (iii) your contact information; (iv) a statement of good-faith belief that the use is unauthorised; (v) a statement under penalty of perjury that the information is accurate; and (vi) your signature.
Counter-notices and repeat-infringer policies are available on request.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant that files stored on the Service will never be lost or corrupted.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOTHEMIXHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless tothemixhub, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) Your Content; (ii) your use of the Service; or (iii) your violation of these Terms or any applicable law.
You may close your account at any time from Settings. We may suspend or terminate your account without notice if you materially breach these Terms or if required by law.
On termination, your right to use the Service ceases immediately. Sections 5 (IP), 11 (Disclaimers), 12 (Liability), 13 (Indemnification), and 16 (Governing Law) survive termination.
We may update these Terms from time to time. Material changes will be notified to registered engineers by email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If we make changes you do not agree to, you may close your account before the effective date.
These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles.
Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us at support@tothemixhub.com. If the matter cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and tothemixhub regarding the Service.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of substantially all of our assets.
